No Litmus Test

Arlen Specter has stated in the Wall Street Journal, “I’ve backed pro-life judges before, and I’ll do so again.” In 1992, I supported Specter in the caucuses for the presidency. The real issue here isn’t whether a judge is pro-life, but whether a judge reads the Constitution in making his rulings. Even pro-life judges aren’t advocating equal protection for the unborn. They merely recognize that the Constitution does not include a right to an abortion. Every once in a while, I am tempted to support Roe v. Wade, but if you support Roe v. Wade, you have to support Lochner too. Unfortunately, only Richard Epstein and a few other academics take that position.
