Ashcroft Decries Court Rulings

In the Washington Post, Ashcroft Decries Court Rulings: “Attorney General John D. Ashcroft said yesterday that federal courts have endangered national security by ruling against the Bush administration on issues related to the war on terrorism.”

It is one thing to aggressively advocate for the executive as his Attorney General. But, taking this position goes beyond that role. I wonder what check Ashcroft thinks the judiciary should exercise against the executive. The war on terror is legitimate and important, but the judiciary must check executive power. This is especially true when, as now, the legislature and executive intentionally sign unconstitutional laws that they expect to be partially overruled by the courts.
